Terms of Service

These Terms describe the rules for creating an account and using ChessCue during closed prelaunch testing.

At a glance

Registration and access

You must be at least 18 years old to create an account or use ChessCue. By selecting the acceptance checkbox and creating an account, or by accepting an updated version in the application, you confirm that you meet this requirement and agree to the version of these Terms presented to you. If you use ChessCue for an organization, you confirm that you have authority to accept these Terms for it.

You must provide accurate information and keep your account details up to date. Keep your credentials secure and do not share your account. You are responsible for activity under your account and must tell us promptly if you believe it has been used without permission.

Acceptable use

Use ChessCue lawfully, respectfully, and only for its intended chess and learning features.

  • Do not use ChessCue to break the law, harm another person, or infringe someone else's rights.
  • Do not interfere with the service, bypass security or usage limits, probe private systems, or access another person's account.
  • Do not scrape, copy, reverse engineer, or attempt to extract the service, models, credentials, or nonpublic data.
  • Do not submit content that you do not have the right to share or that contains unnecessary sensitive personal data.
  • Do not use ChessCue or its output to provide professional advice or to make decisions that require reliable legal, medical, financial, or safety expertise.

Fair play

ChessCue is a learning and review tool. Do not use ChessCue, its AI coach, analysis, suggested moves, voice features, or other assistance during an active chess game, tournament, examination, or other event when outside assistance is prohibited.

You are responsible for understanding and following the fair play, anti cheating, tournament, and platform rules that apply to you. ChessCue may restrict or suspend coaching access when needed to protect fair play or comply with those rules.

Chess content and submissions

You keep the rights you have in games, positions, messages, notes, voice input, and other content you submit. You give ChessCue a worldwide, nonexclusive, royalty free license to host, reproduce, process, display, transmit, and modify that content only as needed to operate, secure, debug, evaluate, and improve the requested service. This license includes sublicensing those limited rights to hosting, security, analytics, support, and AI processing providers acting for ChessCue.

This license lasts while your content is stored for the service and ends when it is deleted, except for copies retained for legal, security, backup, or dispute purposes. Improving the service under this license does not authorize ChessCue to use your content to train general purpose AI models unless ChessCue separately asks for and receives your permission.

You are responsible for having permission to submit imported games and other content. Do not submit another person's private information unless you have a lawful reason and permission to do so.

AI coaching

AI coaching is optional. By using it, you confirm that you are at least 18 years old. ChessCue may send chess context, prompts, saved coaching context, and voice input you choose to provide to Google Gemini to produce coaching responses.

AI output may be incomplete, inaccurate, or unsuitable for your position. Treat it as general chess learning assistance, verify important claims, and use your own judgment. ChessCue does not promise that AI output will be available, correct, unique, or fit for a particular purpose.

To the extent permitted by law and subject to third party rights, you may use the AI output ChessCue provides to you for personal or internal organizational purposes. AI output may not be unique, and other users may receive similar output. You receive no rights in third party content that may appear in an output.

ChessCue uses Google Gemini under ChessCue's provider agreement. You do not contract directly with Google merely by using ChessCue, but you must not use the AI features in a way that would cause ChessCue to violate provider safety, acceptable use, or content restrictions. The Privacy Notice describes how requests are processed.

Third party services

ChessCue may connect to or rely on services such as Google, Chess.com, Lichess, Cloudflare, Vercel, ImageKit, Resend, Lemon Squeezy, Upstash, and PostHog. Those services may have their own terms, policies, availability, and account requirements.

When you connect an account or request an import, you authorize ChessCue to perform the requested action. ChessCue does not control independent services and is not responsible for their content, availability, or practices.

Subscriptions and payments

ChessCue may offer free trials and paid plans. Before purchase, the checkout or plan description will show the price, currency, taxes where applicable, included features, usage limits, billing period, trial terms, and renewal terms. Unless stated otherwise at checkout, a paid subscription renews automatically for the same period until cancelled, and a trial may convert to a paid subscription at the disclosed price unless cancelled before it ends.

You may cancel through the account or merchant controls identified at purchase. Cancellation stops future renewal and normally takes effect at the end of the current paid period. Except where the checkout states otherwise or applicable law requires a refund, charges are nonrefundable and partial periods are not credited. We will provide advance notice of price changes as required by law, and a new price applies no earlier than the next renewal after that notice.

Lemon Squeezy or another provider identified at checkout may act as merchant of record and handle payment, currency conversion, tax, refunds, and subscription administration. You authorize the applicable provider to charge the selected payment method. Failed or reversed payments may result in loss of paid access. Purchases through an application store are also subject to that store's billing and refund rules.

ChessCue content and intellectual property

ChessCue and its licensors own the service, software, branding, design, and materials provided by ChessCue, except for content supplied by users or independent providers. These Terms give you a limited, revocable, nonexclusive, nontransferable right to use ChessCue for personal use or internal organizational use while your account is permitted to access it.

If you send feedback or suggestions, you allow ChessCue to use them without restriction or payment, provided that doing so does not identify you publicly without your permission.

Changes and availability

ChessCue is in closed prelaunch testing. Features, plans, limits, providers, and availability may change, be interrupted, or be withdrawn as we develop the service. We may perform maintenance and may limit access to protect users, providers, or the service.

We may update these Terms as ChessCue changes or as legal requirements develop. Every published version is preserved in the terms archive with its version and effective date. For material changes, we will provide a prominent notice before the change takes effect when reasonably possible, provide any notice required by law, and ask registered users to accept the updated Terms before continuing to use account features when renewed acceptance is appropriate.

Disclaimers

To the fullest extent permitted by law, ChessCue is provided as is and as available, without warranties of any kind, express or implied. We do not warrant uninterrupted availability, error free operation, security, accuracy, or that ChessCue will meet your needs.

You are responsible for deciding whether to rely on chess analysis, imported data, AI responses, or any other output. ChessCue is not a substitute for professional advice or your own review of a position.

Limits of liability

To the fullest extent permitted by law, ChessCue and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, data, goodwill, or opportunities arising from your use of or inability to use ChessCue.

To the fullest extent permitted by law, the total liability of ChessCue for claims relating to ChessCue or these Terms is limited to the greater of the amount you paid to ChessCue in the 12 months before the event giving rise to the claim or 100 US dollars. Nothing in these Terms limits liability that cannot lawfully be limited.

Suspension and termination

You may stop using ChessCue and request account deletion through the available account controls. We may suspend or terminate access if you violate these Terms, create risk for users or providers, fail to pay applicable charges, or if we discontinue the service. If ChessCue discontinues a prepaid paid service before the end of its period, ChessCue will provide any refund or replacement access required by applicable law or the purchase terms.

After termination, your permission to use ChessCue ends. Provisions that by their nature should continue, including ownership, user content licenses needed for retained copies, disclaimers, liability limits, payment obligations, and dispute terms, continue to apply.

General terms

These Terms, the Privacy Notice, and purchase terms presented at checkout form the entire agreement about ChessCue. If they conflict, specific purchase terms control payment details, these Terms control use of the service, and the Privacy Notice controls how personal data is handled.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions stay effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without ChessCue's written consent; ChessCue may assign them as part of a merger, reorganization, financing, sale, or transfer of the service, subject to applicable law.

ChessCue may provide legal notices electronically through the service or by email to the address associated with your account. ChessCue is not responsible for delay or failure caused by events reasonably outside its control. No independent provider is a third party beneficiary of these Terms unless these Terms expressly say otherwise.

Governing law and disputes

The responsible legal entity, business address, governing law, and dispute forum for ChessCue will be identified in this section before public launch. Until then, these Terms describe the operating rules for closed prelaunch testing and do not replace advice from qualified counsel.
